By accessing or using Confetti ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

The Service is provided by GoFetti Pty Ltd (ABN: pending), an Australian company. These terms are governed by Australian law.

2. Description of Service

Confetti provides digital party invitation services including:

• Themed party invitation creation and customization
• QR code generation for RSVP tracking
• Guest list management and RSVP collection
• Dietary requirement and allergy tracking
• Printable invitation PDFs
• Dashboard for party management

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Keep your account information up to date
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be 18 years or older to create an account. The Service is intended for parents and guardians organizing children's parties.

4. Payment and Billing

Pricing

• Free Tier: Limited access (1 party/month, up to 10 guests, basic themes)
• Party Package: $19.99 AUD per party (up to 30 guests, all themes, full features)
• Party Pack: $49.99 AUD for 3 parties (save $10)

Payment Processing

Payments are processed securely by Stripe. We accept major credit cards and debit cards. You authorize us to charge your selected payment method for all purchases.

Refund Policy

Important: All sales are final once you download your party invitations PDF. Refunds are not available after the digital product has been delivered. We recommend using the free tier to test the service before upgrading.

5. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Send spam or unsolicited communications
• Upload malicious content or viruses
• Attempt to gain unauthorized access to our systems
• Impersonate others or provide false information
• Use the service for commercial purposes beyond personal party planning
• Share or resell your account access

6. Intellectual Property

Our Content

The Service, including themes, designs, software, and branding, is owned by GoFetti Pty Ltd and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our content except as necessary for your personal use of the Service.

Your Content

You retain ownership of content you provide (party details, guest names, etc.). You grant us a limited license to use this content to provide the Service. You are responsible for ensuring you have the right to share any information you provide.

Generated Invitations

Invitation PDFs generated through our service are for your personal, non-commercial use only. You may print and distribute them for your party but may not resell or use them for commercial purposes.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is described in our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Service Availability

We strive to provide reliable service but cannot guarantee 100% uptime. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical difficulties
• Force majeure events
• Third-party service interruptions

We will make reasonable efforts to provide notice of planned maintenance.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY TO YOU IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

10. Termination

Either party may terminate these Terms at any time:

• By you: Stop using the Service and delete your account
• By us: For violation of these Terms or for any reason with notice

Upon termination, your access to the Service will cease. Data retention is governed by our Privacy Policy. Provisions that should survive termination (including payment obligations, intellectual property rights, and limitations of liability) will remain in effect.
